Terms of Use

These terms govern your use of scale100.co and anything published or sold on it. By using the site you accept them. If you do not accept them, please do not use the site.

1. Who you are dealing with

Scale100 is operated by Digital First Pty Ltd, ABN 40 157 690 330, trading as Scale100, of New South Wales, Australia.

In these terms, "we", "us" and "Scale100" mean that entity. "You" means anyone using the site.

2. What Scale100 publishes

Scale100 is an independent technology research and journalism business. It publishes news, long-form interviews, written research, registers and reports covering enterprise software and agentic AI.

Some material is free and open. Some is sold, and requires an account and a purchase to read.

3. Accounts

Some content requires an account. Accounts are created and managed through our authentication provider.

When you hold an account you agree that:

•

the details you give us are accurate, and you will keep them current

•

the account is for one person, and you will not share access credentials or verification codes with anyone else

•

you are responsible for activity that occurs under your account

•

you will tell us promptly at info@scale100.co if you believe someone else has gained access to it

We may suspend or close an account that is being shared, or that is being used in a way these terms prohibit.

4. Free content

Free articles and research are published for you to read, quote and link to. You may quote reasonable extracts for commentary, review, reporting or teaching, provided you attribute Scale100 and link to the original.

You may not republish a whole article, or a substantial part of one, without written permission. Ask at licensing@scale100.co. Most requests are granted.

5. Paid reports and research

Please read this clause before you buy a report.

When you buy a report, you are buying a personal, non-exclusive, non-transferable licence to read it online for as long as we make it available, for your own use and the internal use of the organisation that paid for it.

You may:

•

read it, as many times as you like, while your access is active

•

quote short extracts internally, and in external work that attributes Scale100 and links to the report

•

discuss and act on what it says

You may not:

•

share your account, credentials or verification codes so that another person can read it

•

copy, scrape, screenshot, transcribe, export or otherwise reproduce a report in whole or substantial part in order to distribute it

•

resell, sublicense or redistribute a report, or make it available on an intranet, shared drive, file-sharing service or AI system that would make it readable by people who have not bought it

•

use a report, in whole or substantial part, as training data

Reports are deliberately published as gated online content rather than as downloadable files.

Buying a report does not transfer copyright or any other intellectual property right, and grants no right in our names or marks. See section 7.

6. Acceptable use

You agree not to:

•

use the site unlawfully, or to break any law that applies to you

•

attempt to gain access to content, accounts, systems or data you are not authorised to reach

•

scrape, crawl or harvest the site at a scale or rate that burdens it, or in a way that circumvents access controls

•

interfere with the operation or security of the site

•

misrepresent your identity or affiliation when contacting us or creating an account

7. Intellectual property

Everything published on scale100.co – text, research, registers, graphics, video, the Scale100 name and marks – is owned by us or licensed to us, and is protected by copyright and other rights.

Nothing in these terms grants you rights in that material beyond those set out above.

Some of our material is openly licensed. The False Floors register content is published under a Creative Commons Attribution 4.0 licence, and the accompanying code under the MIT licence. Where those licences apply, they govern, and nothing in this section takes back what they grant. The licence text published with the material is the authoritative statement of what you may do with it.

Our names and marks are not part of any of those licences. Creative Commons licences do not license trade marks. False Floors is a trade mark of Digital First Pty Ltd, trading as Scale100, and is the subject of Australian trade mark application AMCZ-2616155657. Scale100 is our trading name.

You may use the name False Floors to refer to the catalogue: to cite it or its rows, to say your tool maps to it, or to make a conformance claim about your own work. No permission is needed for that. You need our permission to use the name for your own product or service, or in a way that suggests we endorse, certify or accredit you. Nothing published on this site, and no use of our openly licensed material, makes any product, assessment or organisation certified, accredited, approved or verified by us.

A false floor, lowercase, describes a kind of failure and belongs to nobody.

8. Editorial independence, and its limits

Scale100 is an independent publisher. We do not take money for editorial positions, and no purchase, licence or commercial arrangement carries a right of review before publication.

We also disclose the commercial arrangements that exist, including that reports are sold to any organisation including vendors, and that conference travel is sometimes paid for by vendors. Those disclosures are published at scale100.co/about.

Nothing on the site should be read as a recommendation given on someone else's behalf.

9. No professional advice

Scale100 publishes research and journalism. It is not professional advice.

Nothing on the site is legal, financial, accounting, taxation, security or investment advice, and nothing on it takes account of your particular circumstances, systems, contracts or obligations. Technology decisions you make after reading our work remain yours.

Get advice suited to your own situation before acting on anything you read here, particularly where a decision involves a material spend, a contract, or a regulated obligation.

10. Accuracy

We correct errors when we find them or when they are pointed out. We do not promise that everything published is free of error, complete, or current at the time you read it. Vendor products, pricing and capabilities change quickly, and research describes a moment.

If you think something we have published is wrong, tell us at editorial@scale100.co. Corrections are welcome.

11. Third-party sites and services

The site links to and embeds material from other services. We do not control those services and are not responsible for their content, availability or practices. Their terms and privacy policies govern your use of them.

12. Availability

We do not promise the site will be available uninterrupted or error-free. We may change, suspend or withdraw any part of it, including content that has been published, though we will not do so lightly with material people have paid for.

13. Suspension and termination

We may suspend or terminate your access if you breach these terms, particularly clause 5 or clause 6.

Where we terminate paid access for a breach, we are not obliged to refund the unused part, except where Australian Consumer Law requires it.

14. Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded.

Subject to that, and to the extent the law permits:

•

we exclude all implied terms and warranties

•

we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill or anticipated savings

•

our total liability arising out of or in connection with the site and these terms is limited to AUD $1,000

15. Changes to these terms

We may update these terms. The current version is always at scale100.co/legal/terms-of-use, with the date it took effect at the top. Material changes affecting paid access will be notified by email to account holders.

Continuing to use the site after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
